FPR Participant Agreement

FamilyPoint Resources (FPR) is located in the Outreach Center of West Houston (725 Bateswood Drive, 77079). FPR is a 501(c)3 nonprofit providing enrichment programs in education, sports, and arts to children from 4 years old to 18 years old. FPR is not a day care facility and is not licensed as a child care facility.

Behavior Policy

I understand that attendance at and participation in FPR Programs is a privilege.  I also understand that the program leaders may contact me if there is a problem with my child’s behavior.  If behavioral issues persist or are deemed by FPR to be severe, I understand that my child may no longer be allowed to participate in certain, or all, FPR Programs.  FPR reserves the right to prohibit any person from participating in any FPR Program at its sole and absolute discretion for any reason or no reason at all.

Transportation Consent

I give my permission for my child to be transported to and from FPR activities by FPR staff and adult volunteers.  FPR generally notifies parents or guardians if participation in an FPR Program will require transportation by FPR.  If you require notification prior to your child being transported to an FPR Program you must notify FPR in writing prior to the date of the FPR Program.

Overnight Trips

Some of FPR Programs require overnight and multiple night trips. You will be notified about any FPR Program that requires overnight or multiple night trips in which your Participant has been invited to attend. If you do not want your Participant to participate in any overnight or multiple night trip, please notify an FPR staff member of your request.

                               

Photo and Media Release

The undersigned consent to the use of photographs, videos, or other media captured during, in which the Participant may appear, for promotional, fund raising or educational purposes related to FPR.

Counseling Consent

I understand that FPR may have licensed counselors, and or counseling practitioners present at FPR Programs.  These counseling professionals are present to help students develop appropriate social interactions and to learn to handle conflicts and emotions in a positive manner.  I consent for my child to take part in interventions and learning opportunities with these professionals.  I understand that one on one, in depth counseling will not occur without my notification and further consent.

                           

FPR Parent Contract

I understand that as a parent/guardian of a child/children who participate in FPR programs, I also have ownership and responsibility in these programs. I understand that anything I contribute could have a positive impact.

I understand that as a parent/guardian my participation may be required for my child to receive a scholarship into FPR programs.

I will volunteer a minimum of 5 hours at FPR this year. Opportunities to volunteer include:

providing snacks for my child’s team after a game, volunteering after school, providing rides to games/activities, helping with data entry and helping at special events

I will make every effort to support my child and encourage attendance in all programs for which my child is registered.

                  

Comprehensive Release

I, certify and agree that I am over the age of 18 years of age and am the parent/guardian of a child participant in activities or events sponsored by FPR.  In this Release, my child or ward, will be sometimes referred to as a “Participant”.  In consideration of Participant being allowed to participate in FPR Programs, I agree as follows:

Participation in FPR Programs may carry a risk of injury to the Participant.  This risk of injury may be significant, with potential of permanent disability or death.  I will or will cause or instruct the Participant to follow all rules of the FPR Program, act within the limits of his or her ability, maintain control of themselves and all equipment used in the activity, and refrain from acting in any manner that may cause or contribute to injury of any other person or themselves.  I fully understand that such rules will not eliminate the potential for injury and I fully assume such risk, on my behalf and on behalf of the Participant.  

I acknowledge FPR has made a good faith effort to make each FPR Program reasonably safe for Participants.  I knowingly and freely assume all such risks for the Participant whether known or unknown, which may be connected with or arise out of each FPR Program in which the Participant participates and accept full responsibility for the Participant’s actions and behavior.  If, I observe an unusual or significant hazard in any FPR Program, I will remove the Participant from participation and bring such hazards to the attention of the program or activity leader immediately.

To the fullest extent permitted by law, I  forever indemnify, release, and hold harmless FPR, its officers, directors, agents, employees, volunteers and sponsors and any owners or lessors of premises or property used in each FPR Program or activity, from any and all liability, claims damages, losses and expenses of any kind (including attorney fees), for property damage or personal injury, including disability or death, which may arise in any way out of  my, or my Participant’s participation in FPR Programs.

I agree on behalf of myself, my heirs and assigns that all the terms and conditions of this Release, including indemnity provisions, shall apply in full force and effect to me as those terms may relate to my and my Participant’s participation in FPR Programs.

In the case that a medical emergency occurs I understand that every effort will be made to contact me with reasonable haste.  In the case that I cannot be reached or am not present, I authorize the bearer of this form to approve any medical treatment or medication deemed immediately necessary by a medical professional and agree that all emergency medical assistance conducted by FamilyPoint, its officers, directors, agents, employees, volunteers and sponsors and any owners or lessors of premises or property used in each FPR Program shall be considered a “Good Samaritan” or similar emergency assistance under applicable law.  

I agree that this release is a full and comprehensive release of all potential liability and obligations of FPR its officers, directors, agents, employees, volunteers and sponsors and any owners or lessors of premises or property used in each FPR Program or activity related to Participant’s participation in FPR Programs to the fullest extent allowed by applicable law and that this release should be interpreted as broadly as possible under applicable law.  

This Agreement shall be interpreted in accordance with the laws of the State of Texas. Any dispute or legal proceeding of any nature relating to this Agreement shall be brought exclusively in state or federal court in Houston, Harris County, Texas.

A copy of this Agreement is located on FPR’s website at www.familypointresources.com. By registering for any FPR Program you accept all terms and conditions of this Agreement and agree that but for your acceptance of the terms and conditions of this Agreement, your Participant would not be allowed to participate in FPR Programs.
